Anti-Spam Policy
Information Collection Process
dbDirector maintains information about "Clients" and "Members", as both terms are
hereinafter defined. "Clients" are individuals or entities that sign an agreement
to use dbDirector. Client information is used to provide access to dbDirector for
the Client and to manage Client activities. "Members" are individual and/or entities
which receive e-mails from Clients via the dbDirector engine. Member information
is used solely by the Client for marketing campaigns, electronic or otherwise, and
other related purposes.
Client and Member activities are monitored and tracked using cookies and other means
for the purpose of system administration and to provide reporting functionality
to our Clients.
Such monitoring and tracking allows dbDirector to better manage the system and allows
Clients to effectively direct their marketing efforts. dbDirector bases its reporting
on the data in its system and does not gather additional information from third
parties or other sources.
Privacy Policies Enforced by Client
Clients are required to maintain appropriate privacy policies regarding their Member
lists. Members can contact a Client to inquire about their privacy policy by replying
to the E-mail which the member receives. dbDirector is no responsible for links
in Client’s e-mail which do not link to the dbDirector site and those sites may
not have or enforce appropriate privacy policies. Therefore, dbDirector is not responsible
for the privacy policies of our Clients or of other companies.
Distribution of Information to Unrelated Parties
dbDirector does not share Client or Member Information with unrelated or third parties.
Member information is collected by Clients and loaded into dbDirector via an online
or other interface. Client's Member information, including e-mail contact information,
is maintained by dbDirector as confidential information to be used exclusively by
Client for the benefit of Client. dbDirector will not collect, transfer, acquire,
sell, rent, or trade Client's Member information, or send unauthorized E-mail to
Client's Members or on behalf of unrelated third parties.
Supplemental Information
All Internet and electronic transfers of data are not entirely secure. It is possible
for unrelated parties who are not under any responsible party’s control, including
that of dbDirector, to access or intercept transmissions or private communications
unlawfully or in violation of best practices. Although dbDirector strives to protect
this all private information, dbDirector cannot ensure or warrant the security of
any information by Clients or Members in any format or media, including information
transmitted by or to us.
All parties, including Clients and Members agree that under no circumstances, including
but not limited to negligence, shall dbDirector be liable for any special, incidental
or consequential damages that result from the use of dbDirector, even if dbDirector
or an authorized representative of dbDirector, has been advised of the possibility
of such damages.
If dbDirector is ever sold or acquired, our Client's accounts and any potential
future revenues may be included in the assets which are sold or acquired. However,
all purchasers or acquire-ring parties shall be required to adhere to this Privacy
Policy.
This privacy policy may be changed at any time with restriction. Such revised policies

Unsolicited E-Mail Policy
This dbDirector Unsolicited E-Mail Policy sets form our policies and practices in
regards to our Clients sending unsolicited bulk email, also known as spam, and to
provide assistance to recipients of such spam.
Sending of spam via the dbDirector system is not permitted, and dbDirector enforces
our Anti-spam Policy using several methods as outlined below.
Notification of Misuse
To report any abuse or violations of the dbDirector service, please forward
the email you received to
. Your report will be registered and the offending Client will be investigated for
violations of dbDirector’s policies on an anonymous basis. dbDirector enforces our
Anti-spam Policy using several methods as outlined below.
Policy Enforcement
dbDirector enforces its Anti-spam policy using several methods:
- We provide ongoing training to our Email Marketing Consultants to consult with
our prospective Clients on the proper methods they can use to build their email
lists, as well as educating prospective Clients on dbDirector Anti-spam policy.
- To the best of our knowledge, dbDirector and the dbDirector system adheres to
ALL state and national laws regarding sending unsolicited bulk email.
- On our agreement with our Clients, our Clients specifically agree NOT to use dbDirector
to send unsolicited email or spam.
- All emails sent using dbDirector include point of origin and routing information
as well as identifying information about the Client that sent the message.
- Before signing up for the dbDirector service, our Clients receive a live training
and consultation including discussing the methods the Client will use to build their
list.
- dbDirector supports multiple OPT-OUT / REMOVE / UNSUBSCRIBE methods including
instructions and a link at the bottom of each email distributed through dbDirector,
automatic opt-out using reply email, and the ability for Clients to remove emails.
- dbDirector maintains an OPT-OUT list that restricts our Clients from adding an
email address to their list that has been previously Opted-Out.
- We track all registered complaints related to each Client, and compare the rates
against historical averages of abuse complaints across our system. If we suspect
a violation of our Anti-spam policy, we will contact the Client and discuss the
Clients options, which may range from a warning to termination of service for that
Client, as well as other remedies.
ISPs and Network Administrators
While we do our best to keep dbDirector free from abuse and encourage our Clients
to use best practices to avoid generating complaints, the huge volume of messages
we send does generate complaints, both to us, to our clients, and to ISPs and Network
Administrators. If you receive complaints about unsolicited email sent from our
service, please forward the email to
, along with your contact information and the company you represent. We will investigate
the complaint and respond to you with the results of our investigation.
OPT-OUT Procedure
Members may unsubscribe from an email list by clicking on the "opt-out" button or
link in the e-mails received. You will be removed from the Member list maintained
by the Client who are designated receivers of e-mail and you should not receive
emails from that Client in the future. However, your information will stay in the
client’s database. If you wish to remove your information completely from the client’s
database, simply send an email back to the email address you received the email
from, and ask to be removed completely from the client’s database. If you have any
questions or need an assistance to be removed from a client’s mailing list, you
may send us an email with the client’s information and your email address.
